Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Sendehm, the real-estate marketing platform operated by Sendehm, based in British Columbia, Canada (“Sendehm”, “we”, “us”). By creating an account or using the service you agree to these Terms. If you do not agree, do not use Sendehm.

1. The service

Sendehm lets real-estate professionals build campaigns from their listings, select city contact lists, reserve send slots, and dispatch campaigns. Pricing is pay-as-you-go in Canadian dollars: a per-contact rate plus a base fee per campaign, with the base fee waived on large campaigns. Current rates are shown in the app at the time you confirm a campaign and may change prospectively.

2. Eligibility & accounts

You must be a real-estate professional (or acting on behalf of one) and able to form a binding contract. You agree to provide accurate information, to verify your email address, and to keep your credentials secure. You are responsible for all activity under your account.

3. Acceptable use & your responsibilities

You may use Sendehm only for lawful, permitted real-estate marketing to business contacts. You agree that:

  • you are the identifiable sender of your campaigns, and the sender details you provide are accurate;
  • you will comply with Canada’s Anti-Spam Legislation (CASL) and, where applicable, other anti-spam and privacy laws; see our Anti-Spam Policy;
  • you will not send false, misleading, deceptive, or unlawful content, and you will honour fair-housing and anti-discrimination obligations;
  • you will not upload content you do not have the right to use, transmit malware, scrape the platform, or attempt to circumvent the platform’s permitted sending basis;
  • EHM may flag fair-housing or compliance concerns; these advisories are informational and do not replace your own legal judgement.

4. Our role; contact lists; EHM

Sendehm provides the platform and the city contact lists, which consist of business contacts whose addresses are conspicuously published and which we make available on a reasonable basis under CASL (see the Anti-Spam Policy). You remain responsible for your use of those lists and the content you send. EHM assists with drafting but does not provide legal, financial, or professional advice, and EHM does not invent property facts. It uses only the information you provide.

5. Content & intellectual property

You retain ownership of your listings, brand, and campaign content. You grant Sendehm a non-exclusive licence to host, process, and transmit that content as needed to operate the service. Sendehm, EHM, the templates, and the platform software remain our property. You may not copy, resell, or reverse-engineer the platform.

6. Payment

You authorise us to charge your saved payment method, through our payment processor Stripe, when you confirm a campaign (an off-session charge). The amount is the per-contact rate times the actual deliverable contact count, plus the per-campaign base fee (waived on large campaigns). You are responsible for any applicable taxes. If a charge fails, we may suspend the campaign or your account until payment is resolved.

7. Cancellation & refunds

Cancellations and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms.

8. Suspension & termination

We may suspend or terminate your account for breach of these Terms, suspected abuse, anti-spam or legal violations, or non-payment. You may stop using the service at any time. Sections that by their nature should survive termination (payment, IP, disclaimers, liability, indemnity, governing law) survive.

9. Disclaimers

The service is provided “as is” and “as available”, without warranties of any kind. We do not guarantee email deliverability, open rates, responses, or any marketing outcome. AI-generated content may contain errors; you are responsible for reviewing everything you send.

10. Limitation of Liability

To the maximum extent permitted by law, Sendehm will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the service is limited to the total fees you paid to Sendehm in the 12 months preceding the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

11. Indemnity

You agree to indemnify and hold harmless Sendehm from claims, damages, and costs arising out of your content, your campaigns and recipients, or your breach of these Terms or of applicable law (including anti-spam, privacy, and fair-housing laws).

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with an updated date; continued use after changes means you accept them.

13. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts located in British Columbia have exclusive jurisdiction over disputes, subject to any non-waivable rights you have under applicable consumer law.
